JUDGE TOSSES TRIPLE FIREFIGHTER LODD LAWSUIT

Posted by Tony Thomas - December 27, 2024 11:47 AM

A judge recently threw out a lawsuit that the families of the three fallen Baltimore City Firefighters, Lt Paul Butrim, Lt Kelsey Sadler, and Firefighter EMT Kenny Lacayo - who were killed in 2022 while fighting that fire in a vacant row home - brought against the city, but they plan on refiling the case.

In a 19-page opinion issued on Dec. 9, U.S. District Judge Matthew J. Maddox wrote that while the allegations in the complaint were “tragic and alarming,” he was constrained to dismiss the case.

Maddox said he did not find the accusations as drafted supported a reasonable inference that the Fire Department acted to harm the firefighters. That is needed to put forward a possible legal argument that there was a state-created danger that violated their constitutional rights.
